Instructions to Students<\/h2>\n

This assignment carries 20% of the marks for this subject.<\/p>\n

The word limit is 1,500 words, and the front cover of your assignment should note the total word count used. Words over the permitted 1,500 will not be read or marked<\/p>\n

This assignment is intended to allow you to consider a range of legal issues that can arise in the contract while carrying on a business and to develop your ability to research and analyze problems from the perspective of those legal issues.<\/p>\n

You are expected to think through the issues thoroughly, consider both parties\u2019 rights and liabilities and provide a reasoned solution to the problems posed by the facts. In particular, you will need to ensure that you cover each of the specific matters that are set out in the question.<\/p>\n

Students may work collaboratively to consider the problems (and are strongly encouraged to do so). Still, individual essays are to be submitted by each student \u2013 and they are to be your work.<\/p>\n

(Students should read and are expected to comply with the university\u2019s policy on plagiarism, generally and about collaborative work submitted individually).<\/p>\n

Students must only submit an electronic copy through a Safe Assignment. Ensure your name and student identification number appear on the cover sheet.<\/p>\n

The Question<\/strong><\/p>\n

Peter wants to sell one of his cars that has a diesel motor to his nephew, Brett. Brett is eager to purchase the car, but Brett does not realize that one of his uncle\u2019s cars is diesel.<\/p>\n

Peter writes a letter to Brett as follows:<\/p>\n

\u201cDear Brett,<\/strong><\/p>\n

I know that you are interested in buying one of my cars. I want to give it to you, but I know that you won\u2019t accept charity.<\/p>\n

Therefore, I will offer it to you for $500 (I reckon it is worth about $2,000). If I don\u2019t hear from you by this Friday, I take it that you are happy to buy it for $500. I will then drop off the car at your place on the weekend.<\/p>\n

Peter\u201d<\/strong><\/p>\n

Brett does not see the letter, and there is no further communication between Peter and Brett.<\/p>\n

On Saturday, Peter delivers the diesel motor car to Brett\u2019s home. Brett arrives home to discover the letter and the car from his uncle.<\/p>\n

Brett realizes the car is diesel and he does not really want the car. However, Brett decides the car is still useful and starts driving the car to and from the university.<\/p>\n

After three weeks of driving the car, Brett decides to return it. He has not yet paid Peter any money. Peter thinks Brett is ungrateful and demands full payment.<\/p>\n
